A viral waiter has pressed charges against transwoman Jude Bacalso, stemming from an incident in Cebu where Bacalso allegedly imposed a two-hour punishment on the waiter for addressing her as “Sir.”
Despite Bacalso’s public apology, the waiter has filed five legal complaints against her, sparking renewed attention on the case.
The controversy erupted when Bacalso, a social media personality, was offended by the waiter’s use of a male pronoun. Bacalso reportedly made the waiter stand for two hours as a form of punishment, an act that drew significant backlash from netizens and celebrities alike.
After the incident, Bacalso issued a public apology, acknowledging her mistake and expressing regret. However, the waiter has now taken legal action, filing charges of unjust vexation, grave scandal, grave threats, grave coercion, and slight illegal detention. The complaints were officially lodged with the Cebu City Prosecutor’s Office on August 28 by the waiter’s attorney, Atty. Ron-Ivan Gingoyon. Additionally, a labor case has been filed against Ulli’s, the restaurant where the incident took place.
Atty. Gingoyon reported, “As of now, the victim is still traumatized but is trying to co-exist with society. We’re also helping him but the effect on his mental health was significant.” He criticized Bacalso for not reaching out personally to the waiter, despite her social media apology.
According to a psychological assessment detailed by Cebu Daily News, the waiter has been suffering from significant trauma, including frequent crying, insomnia, and a fear of public embarrassment. The evaluation recommends trauma-focused psychoeducation to address these issues.
